Small Business Commercial License 10%

The requirements for this license in a nutshell, 10% of retail sales paid to me monthly, that's it! I think this is a good starting point and hopefully it will work well for both parties. If I find that this license agreement needs some adjustments I will email everyone and let them know. Also, if you find something that you think might need some adjustments please email me with what it is and why. I reserve the right to make adjustments to the licensing agreement at any time if I feel it is needed and if I do I will email you promptly.
I think this new way of licensing will be more fair for everyone involved. If you make money, I will make money and the opposite will hold true as well. The only exception to this is the $5.00 initial processing fee. The vast majority of people I've met have been wonderful, there are a few however who will attempt to take advantage of the agreement. It is because of this that I've needed to put into place an accounting system of sorts which I will go into more detail about it below. I am excited to start this new way of licensing and I hope you are too!
Below are the details of the licensing agreement which I reserve the right to modify at any time.
1. A one time processing fee of $5.00 will be charged to start the license, which should be paid using this product.
2. 10% of retail sales paid to me monthly accompanied by a sales statement. This statement will need to include where your product was sold, how much you sold it for, and how many where sold at each location. Both the payment and statement will be due by the 5th of every month.
3. I must get credit for my artwork. If you have a website I will need to get credit on your website anywhere you are displaying my artwork. Depending on the type of product you sell will dictate how you are to give me credit. An example is if you are selling a t-shirt then I would need credit for the artwork on a hang tag or something similar, I am fine with it being inconspicuous. If you are selling your products digitally I will need credit for my artwork on the item and/or in the products literature if it isn't feasible to put it on the product itself.
4. No mass product of any kind. The products are to be made by you or someone you employ. A mass production is a totally separate license.
5. All licenses are on a non-exclusive basis. For exclusivity you will need a different kind of license if it is available. As I am sure you know that once something is licensed exclusively for a particular use no one else can license it for that same use unless there is an end time frame involved in the agreement.
6. If at any time you wish to remove and/or add a business to the list of where you are selling the products using my artwork all you need to do is email me with the change, who they are and when it will take effect. Please adjust your statement accordingly.
7. I will need an email of a photo, scan, jpg, or some other format of your finished products that use my artwork.
8. Our licensing contract can be cancelled at any time by either party with a 30 day advance written notice. The only exception to that is if it is found out that the license agreement is not being followed as per agreement then I reserve the right to cancel the license immediately.
